Green Books Media: Marketing Agreement – Term, Termination, and Refunds
This agreement starts when we both sign a detailed plan (SOW) and continues until either of us ends it as described below.
Ending the Agreement Because of a Problem (Breach):
If either Green Books Media or you fail to meet a significant part of this agreement, the other can end it.
For money-related issues: The agreement can be ended 10 days after written notice if the issue isn't fixed.
For other issues: The agreement can be ended 30 days after written notice if the issue isn't fixed.
Ending the agreement this way takes effect immediately after the notice period and doesn't limit any other actions the non-breaching party might take.
Ending the Agreement for Any Reason (Convenience):
Either Green Books Media or you can end this agreement at any time, with or without a specific reason, by giving written notice beforehand. "Cause" for Green Books Media to terminate includes:
You being abusive or rude to our team or partners.
Your marketing content breaking our guidelines or any laws.
If we receive a complaint from someone else about you, your content, or your royalties.
What Happens When the Agreement Ends:
When this agreement ends, for any reason, you're still responsible for any payments you owed and for things we did before the end date. You will pay Green Books Media for all marketing services provided up to the termination date.
Refunds for Marketing Services:
If Green Books Media ends this agreement without a good reason before we complete the marketing services, we will refund 100% of the fees you paid.
If you end this agreement, or if Green Books Media ends it because of a good reason, or without a good reason after we've completed the marketing services, here's how refunds will work:
(i) For marketing services before you submit your materials:
0-30 days after purchase: 100% refund, minus the greater of $150 or 10% of the fee.
31-60 days after purchase: 50% refund, minus the greater of $150 or 10% of the fee.
More than 60 days after purchase: No refund.
(ii) After you submit your materials but before final approval (if the issue isn't your content breaking our guidelines before design work starts): 50% refund.
(iii) After design work begins but before final approval: 25% refund.
(iv) After you give final approval: No refund.
(v) If Green Books Media ends this agreement at any time because your materials don't meet our content guidelines (we decide this), we will refund 100% of the fee, minus a $300 content review fee.
(vi) For marketing services not part of a package and before we start working on them:
0-30 days after purchase: 100% refund, minus the greater of $150 or 10% of the fee.
31-60 days after purchase: 50% refund, minus the greater of $150 or 10% of the fee.
More than 60 days after purchase: No refund.
For these refund rules, "completed" or "completion" of a service means either when you return the initial questionnaire (whether fully filled out or not) or when Green Books Media or a partner tells you we're starting the service via an onboarding email from your account manager – whichever happens first.
